The Ministerial Committee for Legislation yesterday approved a government bill to regulate a DNA database, from which the police will be able to genetically sample suspects in criminal and security offenses.

For years, the Israeli police lagged behind Western countries, by not regulating the use of the DNA database for the purpose of solving crimes, and until now it has operated in this area without a legal arrangement. In recent years, an inter-ministerial committee chaired by the deputy to the former Attorney General, Judith Karp, has been working on preparing a law that will regulate the construction of the reservoir. When preparing the law, they seriously debated whether to adopt the American model, which is more conservative, where the preservation of privacy is more strict, or the English model, which is more general.

According to the American model, DNA samples are only taken from suspects of the most serious crimes such as rape or murder. According to the British model, the samples are taken from every person suspected of an offense punishable by imprisonment. While the police pressured the Krepp Committee to adopt the British model, the Civil Rights Association demanded that privacy be strictly protected and a stricter model be adopted.

Finally, an interim model was adopted, according to which it will be permissible to take a genetic sample from suspects of acts of prostitution, lewdness, sexual offenses, serious violence, breaking into a car, drugs and security offenses. The police will be obliged to immediately destroy samples of suspects found to be eligible. Yes, it is better for her to take samples from other people from the scene of the incident, including the victims, just for the purpose of cross-referencing, but it will be forbidden to include these samples in the database.
